Terms and Conditions for Marketing and Non-Marketing Text Messages

Express Consent. By opting in to a patient support text messaging program, you consent to receive marketing and non-marketing text messages (SMS) and texts with images (MMS) (including autodialed and/or pre-recorded messages) (the "Services") from Teva Pharmaceuticals USA, Inc., its affiliates, contractors, and agents, including its third-party patient support program service providers, or The Teva Cares Foundation (collectively "Teva") in connection with a Teva Patient Support Program. Consent to these communications is not a requirement to enroll in the Patient Support Program or a condition of purchase.

Message Frequency. The Services involve recurring mobile messages. Please note that Teva brands and services generally have separate text messaging programs. The total number of text messages you receive from Teva, therefore, may vary based on the number of Teva text messaging programs for which you sign-up to receive messages.

Cost. Message and data rates may apply to each text message sent or received in connection with the Service, as provided in your mobile telephone service rate plan, in addition to any applicable roaming charges. Charges are both billed and payable to your mobile service provider or deducted from your prepaid account. Teva does not impose a separate fee for sending text messages.

Opt-Out. You may opt-out of receiving all text messages relating to the Patient Support Program from Teva at any time by sending a reply text stating "STOP." Please note that this will only opt you out of the specific text messaging program for which you received the message. You will remain opted in to other Teva text messaging programs for which you have separately enrolled.

Your Mobile Telephone Number. You represent that you are the account holder for the mobile telephone number you used to opt-in to the Services. You are responsible for notifying Teva immediately (at the toll-free number listed above) if you change your mobile telephone number.

Eligibility. To receive the Services, you must be a resident of the US and 18 years of age or older.

Access or Delivery to Mobile Network is Not Guaranteed. Teva will not be liable for any delays or failures in the receipt of any mobile messages connected with the Services. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator, and is outside of Teva's control.

Privacy. Teva understands and values the importance of your privacy. Please be aware that the data obtained from you in connection with the Services may, among other things, include your cell phone number, carrier name, and message date, time and content. We may use this information to contact you and to provide the services you request from us. These text messages may contain health information. Standard text messaging is not encrypted, and a third party could read these messages. For more information on how we collect and use your information, please read our full Privacy Notice.

NOT MEDICAL ADVICE. The Patient Support Program includes text messages to help you and your caregiver manage your therapy and provide Patient Support Program support. OUR CONTENT AND COMMUNICATIONS ARE NOT INTENDED TO BE A REPLACEMENT OR SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE. THE CONTENT AND COMMUNICATIONS DO NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. YOU ACKNOWLEDGE AND UNDERSTAND THAT YOU WILL SEEK THE ADVICE OF A PHYSICIAN OR OTHER QUALIFIED HEALTH CARE PROVIDER WITH ANY QUESTIONS THAT ARISE REGARDING ANY MEDICAL CONDITION. YOU ACKNOWLEDGE THAT ALL INFORMATION AND GUIDANCE PROVIDED BY YOU IS SOLELY AT YOUR OWN RISK.

Changes to Terms of Use and Conditions. Teva may revise, modify, or amend these Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to www.pssmobileterms.com. You agree to review these Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive text messages will indicate your acceptance of those changes.

Termination of Text Messaging. Teva may suspend or terminate your receipt of Patient Support Program text messages if Teva believes you are in breach of these Mobile Terms and Conditions. Your receipt of Services is also subject to termination in the event that your mobile telephone service terminates or lapses. Teva reserves the right to modify or discontinue, temporarily or permanently, all or any part of the Services, with or without notice. You assume sole responsibility for the proper use and scheduling of any medications, treatments, and procedures related to the patient's health-care and disease management. Teva assumes no responsibility for the accuracy or appropriateness of any information entered by you.
